Політологія та право в міждисциплінарному просторі: порівняльний аналіз національних традицій

Abstract

The article analyzes the correlation between political science and lawwithin the framework of modern interdisciplinary approaches as a fundamentalmethodological problem of the social sciences of the XXI century.Different national traditions of interaction between these disciplines areconsidered, in particular, the American model of «law and politics» with its empiricalapproach to the judicial system as a political actor and the development of behavioralresearch methods; the German school of state studies (Staatslehre) with the traditions of synthetic knowledge about the state and methodological separation of disciplines;the French concept of «sciences of the state» (sciences de l`État) with a strongtheoretical component and historical and institutional approach, the British traditionof «government studies» with a practically oriented institutional analysis ofparliamentary studies; the post-Soviet model, which is being formed in the context ofthe simultaneous institutionalization of political science as an independent disciplineand the transformation of the legal system under the influence of European integration.The author analyzes modern interdisciplinary areas: constitutional politicalscience (constitutional design), judicial political science (courts as political actors),electoral law (the impact of electoral systems on political behavior) and Europeanstudies (a model of interdisciplinary integration).The author reveals specific features of institutionalization of political and legalstudies in different scientific traditions and proposes the author`s own typology ofinterdisciplinary approaches to political and legal analysis.The author outlines the strategic prospects for the development of political andlegal studies in the context of the global democratic backslide and the need to rethinkthe traditional relationship between law and politics in authoritarian and hybridpolitical regimes of our time.

Стаття аналізує співвідношення політології та права в рамках сучасних міждисциплінарних підходів як фундаментальну методологічну проблему соціальних наук XXI століття. Розглянуто різні національні традиції взаємодії цих дисциплін, зокрема американська модель «law and politics» з її емпіричним підходом до судової системи як політичного актора та розвитком біхевіоральних методів дослідження; німецька школа державознавства (Staatslehre) з традиціями синтетичного знання про державу та методологічним розмежуванням дисциплін; французька концепція «наук про державу» (sciences de l`État) з сильним теоретичним компонентом та історико-інституційним підходом, британська традиція «government studies» з практично-орієнтованим інституційним аналізом парламентських студій; пострадянська модель, яка формується в умовах одночасної інституціоналізації політології як самостійної дисципліни та трансформації правової системи під впливом європейської інтеграції. Проаналізовано сучасні міждисциплінарні напрями: конституційну політологію (конституційний дизайн), судову політологію (суди як політичні актори), електоральне право (вплив виборчих систем на політичну поведінку) та європейські студії (модель міждисциплінарної інтеграції). Виявлено специфічні особливості інституціоналізації політико-правових досліджень у різних наукових традиціях та запропоновано авторську типологію міждисциплінарних підходів до політико-правового аналізу. Окреслено стратегічні перспективи розвитку політико-правових студій в контексті глобального демократичного відкату та необхідності переосмислення традиційного співвідношення права і політики в авторитарних та гібридних політичних режимах сучасності.
