Чи існують правові основи «гібридної війни»?

Abstract

Проведено аналіз сучасних підходів у практиці міжнародного права до понять «гібридна війна», висвітлено різне розуміння щодо інтерпретації цього явища. Визначено, що наявні механізми правового регулювання феномену «гібридна війна» не є ефективними сьогодні. Показано необхідність пошуку альтернативних юридичних оцінок щодо кваліфікації феномену «гібридної війна» з точки зору сучасного міжнародного права.

An analysis of modern approaches in the practice of international law to the concept of «hybrid war» was carried out, different understandings regarding the interpretation of this phenomenon were highlighted. It was determined that the existing mechanisms of legal regulation of the «hybrid war» phenomenon are not effective today. The necessity of finding alternative legal assessments regarding the qualification of the phenomenon of «hybrid war» from the point of view of modern international law is shown.
