Концепція Smart-договорів: правова конструкція в умовах цифрової трансформації

Abstract

Досліджено концепцію smart-договорів як результат цифрової трансформації класичних договірних відносин. Розглянуто механізм їх функціонування на основі блокчейн-технологій, встановлено відмінність між smart-договорами та електронними договорами. Обґрунтовано потребу у правовому визнанні dual nature smart-договору — як одночасно волевиявлення та коду. Зроблено висновок про необхідність імплементації адаптованих норм у Цивільний кодекс України.

The concept of smart contracts is explored as a result of the digital transformation of traditional contractual relations. The mechanism of their operation based on blockchain technologies is examined, and the distinction between smart contracts and electronic contracts is established. The need for legal recognition of the dual nature of smart contracts — as both a manifestation of will and as code — is substantiated. It is concluded that there is a necessity to implement adapted provisions into the Civil Code of Ukraine.
