Правовий захист персональних даних: конституційний вимір

Abstract

The report analyzes the constitutional principles of ensuring information security in Ukraine. It is found that the Constitution of Ukraine is the foundation of legal regulation in the field of information relations and defines information security as a component of national security. The provisions of Articles 17, 31, 32, 34 of the Fundamental Law are considered, which establish a balance between guarantees of the right to information, protection of personal data and the possibility of their restriction in the interests of national security. The conclusion is made about the decisive role of constitutional norms in the formation of an effective state information policy and ensuring the cyber resilience of Ukraine.

В доповіді проаналізовано конституційні засади забезпечення інформаційної безпеки України. З’ясовано, Конституція України є фундаментом правового регулювання у сфері інформаційних відносин та визначає інформаційну безпеку складовою національної безпеки. Розглянуто положення статей 17, 31, 32, 34 Основного Закону, які встановлюють баланс між гарантіями права на інформацію, захистом персональних даних та можливістю їх обмеження в інтересах національної безпеки. Зроблено висновок про визначальну роль конституційних норм у формуванні ефективної державної інформаційної політики та забезпеченні кіберстійкості України.
