Культурологічні виміри права як питання історичного знання (до постановки проблеми)

Abstract

Актуальність проблеми осмислення засад права у нашому суспільстві полягає у величезному впливі російської історичної та юридичної думки, включаючи її радянський варіант. В історичному аспекті головна проблема полягає в перекручені текстів та значення подій. В юридичному аспекті головна проблема виглядає як абсолютизація позитивізтського підходу, коли право і закон ототожнюються. Для надання поняттю права його історичного значення, що склалося в Європейській гуманістичній культурі, потребує дослідження, по-перше, історичний шлях його осмислення, по-друге, можливі засади в українській культурі. Для означення деяких висновків такого дослідження пропонується використання поняття «культурологічні виміри».

The relevance of the problem of understanding the principles of law in our society lies in the enormous influence of Russian historical and legal thought, including its Soviet version. In the historical aspect, the main problem lies in the distortion of texts and the meaning of events. In the legal aspect, the main problem appears to be the absolutization of the positivist approach, when right and law are identified. To give the concept of right its historical meaning, which has developed in European humanistic culture, it is necessary to study, firstly, the historical path of its understanding, and secondly, possible foundations in Ukrainian culture. To define some of the conclusions of such a study, the concept of "culturological dimensions" is proposed.
